After years of handling complex personal injury cases, attorneys have learned that the best referrals start with a clear conversation. Here are five key things they wish referring lawyers would share before sending a case.

Share the Story, Not Just the File

Before sending over a 300-page medical record, give a 60-second overview of what happened. Who was injured? When and how? Who’s responsible? What makes this case significant? This provides a framework for the receiving lawyer to understand the case, especially in complex scenarios involving catastrophic injuries or multiple defendants.

For example, a useful referral conversation might start with: My client was injured in a chemical facility explosion, suffering severe burns and a brain injury. We suspect multiple parties are involved, and evidence may be at risk. This human story sets the stage for the legal details to follow, ensuring the receiving attorney grasps the case’s essence before diving into documents.

Be Open About What You Don’t Know

It’s normal to have unanswered questions in complex cases. Be upfront about what’s unknown: incomplete insurance info, unclear ownership, or an evolving medical prognosis. This helps the receiving lawyer plan next steps and identify immediate priorities. Make a list of what’s known, what’s unknown, and what needs further investigation, as this transparency supports trust and collaboration.

Addressing Case Weaknesses and Client Expectations

Every case has its vulnerabilities, and experienced attorneys know that transparency about these weaknesses is essential. Referring lawyers should identify and communicate potential issues, such as inconsistent client statements, unfavorable social media content, complex liability, or preexisting medical conditions. By asking, If you were defending this case, what would you attack first? attorneys can anticipate challenges and develop strategies to address them proactively, strengthening the case’s overall position.

Referring lawyers should also communicate what they’ve already done and what the client has been told. This includes actions like sending demand letters, filing suits, or conducting depositions, as well as managing client expectations about communication, fees, litigation strategy, and settlement authority. Clear communication ensures the client remains informed and trusts the referral process.

Defining the Referral Relationship

Clarifying the desired referral relationship is key for a successful collaboration. Referring lawyers must decide whether they are stepping away entirely, remaining involved in certain aspects, or seeking co-counsel. This decision should be communicated clearly to the receiving lawyer, along with any specific resources or expertise required for the case. The receiving lawyer also has responsibilities, such as asking questions, listening carefully, and respecting the referring lawyer’s relationship with the client. Most importantly, both attorneys should remember that there is a person at the center of every case, and the referral should be handled with the care and trust it deserves.
